Отказ от одноразового пластика: миф или ближайшее будущее?

3 июля по всему Европейскому союзу вступает в силу запрет на одноразовые пластиковые товары, такие как трубочки, посуда, ватные палочки и другие. Однако предприниматели на Кипре требуют разрешить им использовать одноразовый пластик и после этой даты.

Представители бизнеса мотивируют свое требование тем, что на складах осталось много неиспользованной пластиковой продукции, которая не пользовалась спросом во время пандемийных ограничений. Предприниматели призвали отложить запрет на пластик, чтобы позволить компаниям сбыть оставшийся товар.

Торгово-промышленная палата Кипра (ТППК) привела в качестве примера известную фабрику по производству мороженого. «В прошлом году компания импортировала миллион пластиковых стаканчиков со своим логотипом, но из-за пандемии и небольшого числа туристов они смогли использовать только 300 000», – сказал Андреас Андреу, директор департамента промышленности ТППК, добавив, что остальные стаканчики компания намеревалась использовать этим летом. «Если запретят использовать одноразовый пластик, что им делать?» – задается вопросом Андреу. Производители мороженого не единственные, кто может пострадать от запрета. По словам представителя ТППК, все предприятия просят, чтобы им было предоставлено время для использования пластиковых предметов как минимум в течение этого летнего сезона.

 

Что запретят c 3 июля?

Директива ЕС, запрещающая одноразовый пластик в пользу более экологичных альтернатив, включает в себя запрет на ватные палочки, пластиковые соломинки, тарелки, столовые приборы, чашки, мешалки для напитков, воздушные шарики и пластиковые стержни к ним, контейнеры для пищевых продуктов и напитков из пенополистирола (с крышкой или без крышки), пластиковые чашки, а также изделия из оксо-биоразлагаемого пластика. Законопроект, гармонизирующий национальное законодательство с этой директивой ЕС, еще даже не внесен в парламент для обсуждения и голосования. В настоящее время он находится в Юридической службе на проверке и будет рассмотрен уже парламентом нового созыва.

 

Юридические нюансы процедуры 

Эфи Ксанту, заместитель председателя «Партии зеленых», сказала, что законопроект, скорее всего, будет вынесен на обсуждение сразу после того, как новый парламент возобновит свою работу. Но, по ее словам, скорость его утверждения будет зависеть от состава нового парламентского комитета по окружающей среде. Если в нем будет много новых представителей, они могут не согласиться просто проголосовать за законопроект до его исчерпывающего обсуждения. Ксанту также отметила, что некоторые компании, особенно крупные сети супермаркетов, кофеен и ресторанов, уже приняли меры для отказа от пластика с 3 июля. Департамент защиты окружающей среды сообщил, что компании, которых затронет новая мера, были проинформированы как через ТППК, так и через Федерацию работодателей и промышленников (OEV) или другие неправительственные организации.

Но Андреас Андреу из ТППК настаивает, что, если парламент быстро не примет законопроект о включении директивы ЕС в национальное законодательство, эта мера не сможет быть реализована с 3 июля. Для этого европейские директивы должны сначала быть включены в национальные законодательства. По его словам, этого не произойдет к 3 июля по той простой причине, что законопроект еще не вынесен на обсуждение. Кроме того, когда законопроект наконец будет направлен в парламент для обсуждения, всем заинтересованным сторонам, включая ТППК, будет предложено высказаться, а этот этап обычно занимает много времени, особенно, если последует много возражений.

Однако, как сообщили в Министерстве сельского хозяйства, директивы, даже если они еще не включены в национальное законодательство, также имеют обязательную юридическую силу. На вопрос о том, будет ли запрет действовать, если законопроект не будет принят парламентом до 3 июля, в Минсельхозе заявили, что «положения директивы должны применяться с 3 июля 2021 года». «Европейские директивы представляют собой обязательный закон, который вступает в силу с указанной в нем даты», – отметили в ведомстве. Министерство сообщило, что их цель по-прежнему состоит в том, чтобы законопроект был принят к 3 июля, при этом они признали, что риск санкций ЕС за любые задержки «можно считать маловероятным».

 

Бизнес: как не допустить потерь

Но даже если законопроект будет принят вовремя, Торгово-промышленная палата настаивает на отсрочке его реализации, чтобы дать время предприятиям использовать весь свой пластик. Это должно помочь компаниям избежать больших финансовых потерь, которые могут привести к потере рабочих мест. В своем письме министру сельского хозяйства Костасу Кадису, направленном еще в декабре 2020 года, ТППК, ссылаясь на финансовые последствия пандемии, указывала, что реализация директивы создаст «непреодолимые препятствия кипрским предприятиям». В качестве альтернативы организация предложила ввести запрет после окончания туристического сезона. «Еврокомиссия не одобрила никаких переносов сроков», – ответили ТППК в Минсельхозе. Директива будет внедрена в закон об отходах производства, а это значит, что к нарушителям будут применяться санкции из этого закона.

Тем временем несколько некоммерческих экозащитных организаций начали работать с бизнесом, чтобы помочь ему отказаться от одноразового пластика. В частности, TUI Care Foundation начала пилотный проект в регионе Фамагусты с компаниями туристического сектора. «Мы сотрудничаем с более чем 80 предприятиями в районе Фамагусты в рамках этой инициативы и предлагаем им альтернативные способы замены одноразового пластика», – рассказывает координатор проекта Панайота Куцофта.

Похоже, что власти настроены решительно и пластиковая продукция, вредная для окружающей среды, действительно скоро уйдет в прошлое.

    1            Application of terms

    1.1        These Terms apply to your use of the Website. By accessing and using the Website:

    a            you agree to these Terms; and

    b            where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms

    3            Definitions

    In these Terms:

    including and similar words do not imply any limit

    Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis

    personal information means information about an identifiable, living person

    Terms means these terms and conditions titled Terms and conditions of use

    Underlying System means any network, system, software, data or material that underlies or is connected to the Website

    We, us or our means VESTNIK KIPRA Group

    Website means https://vkcyprus.com/

    You means you or, if clause 1.1b applies, both you and the other person on whose behalf you are acting.

     

    4            Your obligations

    4.1        You must provide true, current and complete information in your dealings with us and must promptly update that information as required so that the

    information remains true, current and complete.

    4.2        You must:

    a not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and

    b unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

    4.3 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms.
     

    5            Intellectual property

    We (and our licensors) own all proprietary and intellectual property rights in the Website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

    6.1        To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

    a the Website being unavailable (in whole or in part) or performing slowly;

    b any error in, or omission from, any information made available through the Website;

    8.1        You are not required to provide personal information to us, although in some cases if you choose not to do so then we will be unable to make certain sections of the Website available to you.     10         General

    10.1      If we need to contact you, we may do so by email or by posting a notice on the Website. You agree that this satisfies all legal requirements in relation to written communications.

    10.2      These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the

    Republic of Cyprus.

    Each party submits to the non-exclusive jurisdiction of the Courts of the Republic of Cyprus in relation to any dispute connected with these Terms or the

    Website.

    10.3      For us to waive a right under these Terms, the waiver must be in writing.

    10.4      Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 5, 6, 7, 10.1, continue in force.

    10.5      If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent

    required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as

    severed from these Terms. The remainder of these Terms will be binding on you.

    10.6      These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or

    agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not

    expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
